There remain to be considered reforms which address obstacles to independent judicial decision-making that arise from within the judiciary itself, as distinct from those that are imposed from other parts of the political system. These are obstacles caused by the inability of courts to provide impartial adjudication – problems of judicial capacity and biased proceedings – and by the behaviour of individual judges who are either biased in their attitudes towards defendants and litigants, or corrupt.
